Terms of Service
1. Acceptance of these terms
These Terms of Service (the Terms) govern your access to and use of the website at https://wattlepaediatrics.online (the Website) and any health and wellness services engaged through Wattle Paediatrics Pty Ltd (we, us or our). By accessing the Website, submitting an enquiry, or engaging our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website or our services.
Where services are provided to a child, references to you include the parent, guardian or carer who engages those services on the child's behalf and who warrants they have legal authority to do so.
2. Who we are
Wattle Paediatrics Pty Ltd (ABN 49 702 779 119) is a health and wellness practice providing paediatric allied health and related support services from Melbourne, Victoria, Australia. You can contact us at ceo@wattlepaediatrics.online.
3. Nature of our services
Content on the Website is provided for general information only. It does not constitute medical advice, diagnosis or treatment, and it does not create a therapeutic relationship. You should not delay seeking, or disregard, professional health advice because of anything you have read on the Website.
The specific scope, frequency and fees of any services engaged will be set out in a separate service agreement, service booking or written confirmation provided to you before or at the time of engagement. Where there is any inconsistency between these Terms and a signed service agreement, the signed service agreement prevails to the extent of the inconsistency.
4. Eligibility and referrals
Some services may require a referral, care plan or funding approval (for example, under a National Disability Insurance Scheme (NDIS) plan, a Medicare care plan, or a referral from a general practitioner or paediatrician). It is your responsibility to provide accurate and current information about eligibility, funding and the child's health needs. We may decline or discontinue a service where eligibility requirements are not met or where we assess that a service is not clinically appropriate, in which case we will explain our reasoning and, where possible, suggest alternative options.
5. Fees, payment and funding
Fees for our services are set out in our fee schedule or in your service agreement and are charged in Australian dollars (AUD). Unless otherwise stated in writing:
- fees are payable on the terms set out in your invoice or service agreement;
- where services are funded by a third party (such as the NDIS), billing will follow the applicable funding arrangements and price guides current at the time of service; and
- you remain responsible for any fees not met by a third-party funder.
Overdue amounts may be recovered, and we may suspend further services until outstanding amounts are paid, except where we are prevented from doing so by law or by the terms of a funding body.
6. Cancellations and non-attendance
We ask that you provide as much notice as possible if you need to cancel or reschedule an appointment. Cancellation fees may apply where insufficient notice is given or where a scheduled session is not attended, consistent with our service agreement and any applicable funding body rules. We will always try to be flexible where cancellations arise from illness, emergencies or other genuine circumstances, and we will explain any applicable fee before it is charged.
7. Health information, records and confidentiality
You agree to provide accurate, complete and current information about the child's health, development and circumstances, and to tell us promptly about any significant changes. Our collection, use, storage and disclosure of personal and health information is governed by our Privacy Policy and by applicable Australian laws, including the Privacy Act 1988 (Cth) and relevant health records legislation.
Health records are retained and disposed of in accordance with our legal and professional obligations. You may request access to, or correction of, personal information we hold by contacting us at ceo@wattlepaediatrics.online.
8. Telehealth and online sessions
Where services are delivered by telehealth or other online means, you are responsible for ensuring a suitable, private environment and a working internet connection. Telehealth is not appropriate for every situation, and we may recommend in-person assessment or referral where clinically appropriate. Telehealth sessions are not suitable for urgent or crisis situations; in an emergency you should contact your nearest hospital emergency department or local emergency services.
9. Your responsibilities
When using the Website and engaging our services, you agree to:
- provide truthful and accurate information and not impersonate any person;
- use the Website lawfully and not attempt to disrupt, scrape, hack or misuse it;
- treat our staff, practitioners and other clients with courtesy and respect; and
- comply with any reasonable safety, infection control or workplace policies that apply when attending our premises or receiving services.
We may suspend or end services, and may restrict access to the Website, if these responsibilities are seriously breached.
10. Intellectual property
All content on the Website, including text, graphics, logos and design, is owned by or licensed to Wattle Paediatrics Pty Ltd and is protected by Australian and international intellectual property laws. You may view, download and print content for your own personal, non-commercial use in connection with your engagement with us. You must not reproduce, adapt, distribute or commercially exploit our content without our prior written consent.
Resources, programs, reports and written materials prepared for you as part of a paid service are provided for your personal or the child's therapeutic use and must not be resold or published without permission.
11. Third-party links and services
The Website may contain links to third-party websites, funding portals or resources. These links are provided for convenience only and do not imply endorsement. We do not control third-party content and are not responsible for its accuracy, availability or privacy practices. Your use of third-party services is at your own risk and may be governed by separate terms.
12. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights that you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, including consumer guarantees relating to the supply of services with due care and skill, fitness for purpose and reasonable timeliness.
To the extent permitted by law, our liability for any breach of a consumer guarantee or other non-excludable obligation is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
13. Limitation of liability
To the fullest extent permitted by law, and except for the non-excludable rights described in section 12, we are not liable to you for any indirect, incidental, special or consequential loss or damage, or for loss of profit, opportunity or data, arising from your use of the Website or our services. Our total aggregate liability arising out of or in connection with the services is limited to the fees you have paid to us for the service giving rise to the claim, except where the law requires otherwise.
Nothing in this section limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or liability arising from fraud.
14. Indemnity
You agree to indemnify us, and hold us harmless, against any loss, claim or expense arising from your breach of these Terms, your unlawful use of the Website, or information you provide to us that you knew, or ought reasonably to have known, was false or misleading, except to the extent caused by our own negligence or breach of these Terms.
15. Suspension and termination
We may suspend or terminate services, and you may end your engagement with us, in accordance with your service agreement or by giving reasonable written notice where no service agreement applies. On termination, we will provide reasonable handover information, subject to our legal and professional obligations, and any fees for services already delivered will remain payable.
We may update, suspend or discontinue any part of the Website at any time without notice.
16. Complaints and feedback
We welcome feedback and take complaints seriously. If you are unhappy with any aspect of our service, please contact us at ceo@wattlepaediatrics.online and we will acknowledge your complaint and work with you towards a resolution. You may also be entitled to raise concerns with external bodies, including the relevant health complaints regulator in Victoria or the NDIS Quality and Safeguards Commission, where applicable.
17. Governing law
These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
18. Changes to these Terms
We may update these Terms from time to time. The current version will always be published on this page with a revised "last updated" date. Material changes that affect existing clients will be communicated to you before your next appointment or service.
